The metaphysical status of the placenta has bearing on several ongoing discussions within Catholic moral theology. Numerous bioethicists and theologians have touched on this topic briefly, but to date no robust metaphysical argument appears in the literature. The authors aim to provide such an analysis. First, they provide an overview of the existing literature on the topic. Second, they briefly review the anatomy and physiology of the placenta. Third, they provide metaphysical and biological reasons why the placenta cannot be a (...) part of the fetus, a part of the mother, simultaneously a part of both, the border at which mother and fetus meet, or a separate individual substance. Perfect Harmony and Melting Strains assembles interdisciplinary essays investigating concepts of harmony during a transitional period, in which the Pythagorean notion of a harmoniously ordered cosmos competed with and was transformed by new theories about sound - and new ways of conceptualizing the world. From the perspectives of philosophy, literary scholarship, and musicology, the contributions consider music's ambivalent position between mathematical abstraction and sensibility, between the metaphysics of harmony and the physics of sound. L. J. Savage and I. J. Good have each demonstrated that the expected utility of free information is never negative for a decision maker who updates her degrees of belief by conditionalization on propositions learned for certain. In this paper Good's argument is generalized to show the same result for a decision maker who updates her degrees of belief on the basis of uncertain information by Richard Jeffrey's probability kinematics. This study evaluated how gender is related to children’s intelligence beliefs, goal orientations and academic achievement and whether there are gender differences in how intelligence beliefs and goal orientations are related to academic achievement. The participants, 362 seventh grade students, completed measures regarding their intelligence beliefs and goal orientations at the beginning of the second semester and the grades were collected at the end of the semester. Girls reported higher scores on incremental belief, mastery goal and higher achievement but lower (...) levels of performance avoidance compared to boys. The relations between intelligence beliefs and academic achievement were fully mediated by both performance goals. Further, there were no gender differences in the associations among intelligence beliefs, goal orientations and achievement. In this essay, some of the signatories to “Medical Intervention in Cases of Maternal–Fetal Vital Conflicts: A Statement of Consensus” respond to “The Placenta as an Organ of the Fetus: A Response to the Statement of Consensus on Maternal–Fetal Conflict,” both recently published in this journal. The response examines Bringman and Shabanowitz’s claims and assumptions about the morally relevant pathologic condition in some cases of peripartum cardiomyopathy complicated by a subsequent pregnancy, the moral status of a normally functioning placenta, and (...) the use of the principle of double effect in these cases. It is important to understandfactors that influence management decisionsthat determine the level of diversificationwithin cropping systems. Because of the widevariety of cropping systems within a region,our study focused on a single county in northwestern Minnesota. This county wasselected because it is in an area where farmerswere reevaluating their cropping practicesduring the 1990s in response to severe plantdisease outbreaks and economic stresses. Asurvey and follow-up interviews of representative farmers in Marshall Countyshowed that they were approaching theircropping systems management decisions underthese conditions (...) through a dominant conceptualframework and two secondaryconceptual frameworks, which we termed “mental causalmodels.” The study illustrates the ways farmersdefine and make decisions affecting theircropping systems diversity under conditions ofagronomic and economic adversity. Wir verlassen uns darauf, dass auch Andere ganz selbstverständlich dargestellte Welt von wahrgenommener Welt unterscheiden. Auf die Darstellungen von Darstellungsformen hat sich moderne Kunst spezialisiert. Am Beispiel der Gegenwartskunst wird die Vermehrung, Kombinatorik und wechselseitige Bezugnahme künstlerischer Formen als Katalysator für innerkünstlerische Transformationen identifizierbar.

I had a strange dream, or half-waking vision, not long ago. I found myself at the top of a mountain in the mist, feeling very pleased with myself, not just for having climbed the mountain, but for having achieved my life's ambition, to find a way of answering moral questions rationally. But as I was preening myself on this achievement, the mist began to clear, and I saw that I was surrounded on the mountain top by the graves of (...) all those other philosophers, great and small, who had had the same ambition, and thought they had achieved it. And I have come to see, reflecting on my dream, that, ever since, the hard-working philosophical worms have been nibbling away at their systems and showing that the achievement was an illusion. True, their skeletons, indigestible to worms, remained, and were surprisingly similar to one another. But I was led to think again about what one can, and what one cannot, achieve in this direction. Leslie Graves, Barbara Horan and Alex Rosenberg (1999) have argued that the process of evolution is really deterministic, so we should be instrumentalists about our probabilistic evolutionary theory. I criticize the consistency of their view. I argue that because they are realists towards multiple theories (quantum mechanics and macrophysics) their arguments against realism for another scientific theory fail. The main point of this paper is critical, but in order to set up this criticism I explore the ramifications of realism (...) for multiple theories. Finally, I offer a brief metaphysical justification for realism about multiple theories. This view justifies realism for evolutionary theory, which has been defended by Robert Brandon and Scott Carson (1996). (shrink)

With the publication in 1974 of an inscribed ‘Orphic’ gold leaf from Hipponium in Southern Italy, and that in 1977 of another, now at Malibu, California, we have a relatively extensive series of gold leaves from graves bearing brief instructions concerning the afterlife. Whether these are Orphic, Pythagorean or whatever, will not be in question here; but the relation between the different texts constitutes a problem interesting in itself, whose dispassionate exploration may also contribute to the eventual understanding of (...) the religious background. The term “abortion” is conveniently used, for my present discussion, to refer to deliberate removal of a fetus from the womb of a human female, at the request or through the agency of the mother, so as in fact to result in the death of the fetus but with insignificantly small risk to the life or health of the mother. The question I want to raise is roughly whether abortion in that sense is morally wrong. I am not raising the (...) question whether abortion should be prohibited by law. That is a very different question and I am confining myself to the moral issue. There is another question I am not raising; whether a fetus should be removed, irrespective of the preferences of the mother, when there is good reason to think the child will be seriously defective, mentally or physically. Since it is a grave responsibility to bring a human being into the world, I think this latter is an important question; but I here do not propose to discuss it. (shrink)

This essay is composed of five stories written by practicing physicians about their patients. Each clinical story describes a challenging ethical condition–potential abuse of medical power, gravely ill and probably over-treated newborns, iatrogenic narcotic addiction, deceived dying people. Rather than singling out one ethical conflict to resolve or adjudicate, the authors attempt, through literary methods, to grasp the singular experiences of their patients and to act according to the deep structures of their patients' lives. Examining these five stories with simple (...) literary tools–attention to narrative frames, time, plot, and desire–reveals the mechanisms through which acts of writing and reading contribute to clinical clarity and ethical actions. Muʽtazilah is one of the kalām schools in which intellectual freedom is seen the most and therefore divergences within the sect are the most common. Although al-usûl al-ḥamsa/five principles constitute the main framework on which Muʽtazilah has agreed, opposing ideas have emerged within the sect on the principles of ʽadl (divine justice) and al-manzilah bayna al-manzilatayn and on the issues of nature and imamah. As a matter of fact, Muʽtâzilī scholars wrote many refutations to each other on the disputed issues. (...) One of those who have opposing views within the Muʽtazilah is Muḥammad b. Shabīb al-Baṣrī (d. mid 3rd/9th century), who lived between the end of 2nd and the middle of the 3rd century of hijra. Ibn Shabīb is one of the students of Ibrāhīm Ibn Sayyār al-Naẓẓām (d. 231/845), who was one of the leading scholars of Muʽtazilah. He initially opposed the principle of al-manzilah bayna al-manzilatayn, while he was Muʽtezilî, and accepted the Murji’ah approach on this issue. However, after he accepted the idea of irjā’, he continued his loyalty to Muʽtazilah with regard to the principles of tawhīd (divine unity) and ʽadl. Ibn Shabīb, who had a theological assembly of his own and is respected by the people in Baṣra, was an important scholar who stands out with his comprehensive knowledge of religious and philosophical schools of his time. In the doxographical tradition, his adoption of Murjī’ ideas is generally emphasized, except that he has not been referred to much. However, when the sources of kalām are examined meticulously, it is understood that he influenced many Muslim theologians with his works and views and that he was a source for them regarding many topics. The most important reason for this is that he was one of the first scholars to defend the Islamic belief against various philosophical and religious movements. Naturally, this situation provided him with a wide knowledge of religious and philosophical trends. Considering the quotations made from him, it is understood that he recorded this accumulation in a doxographical work. Another remarkable feature of Ibn Shabīb is that he was one of the first scholars to write in the genre of Kitāb al-Tawhīd. It is possible to see both contextual and methodological effects of this work in the quotations and narratives of Al-Māturīdī's book with the same name. What makes him different is that he adopts Muʽtazilī and Murjī’ ideas at the same time and develops a unique discourse on the subjects of grave sins and waʽīd (divine warning). Although he was raised in a strong tradition of thought such as Muʽtazilah, his ability to oppose his sect and his teacher Al-Naẓẓām and also to develop a different definition of faith despite accepting the doctrine of irjā’, makes him stand out as an original and intellectual personality. His different definition of faith is important in that it represents a more moderate approach to the issue of takfīr. For, he drew an encompassing framework based on the Quran and the Sunnah regarding the definition of faith and the conditions of takfīr, thus, he tried to preserve the unity of Muslims. He did not consider the denial of controversial issues that are not explicitly included in the Quran and Sunnah as a reason for takfīr. With this attitude, Ibn Shabīb took an important approach in ensuring social peace and free thought. In this article, all the information contained in Muʽtazilī sources, and doxographical works related to the life, scientific personality and theological views of Ibn Shabīb are gathered and analyzed, and then his theological thought is reconstructed based on these data. From this point of view, identifications and evaluations have been made regarding the issues that make him different and unique in the history of Muslim thought. (shrink)

Like… tears… in rain. Time… to die." . With these lines Roy testifies to his memories and to his death, a death that has, in a sense,already taken place, and one that is, by definition, prohibited. While one cannotexperience one’s own death, death is not strictly a limit (...) on the ‘other side’; it comes to usfrom the grave, haunting our lives here and now. If there is a being-towards-death, there isa death-towards-being, and in this interminable aporia, Roy, the ‘replicant’, testifies toDeckard, the ‘human’ – who might himself be a replicant. Roy gives his memories, and doesnot ask for return. He gives, he dies. And he has become immortal, `tears in rain’ havingbecome the film’s signature to which the fans continue to countersign,attesting to Roy’s testimony. Between the signature and countersignature there is aresonance and an affiliation, to the point, as paradoxical as this may seem, where it cannotbe properly distinguished which came first. Did Roy’s signature call for itscountersignature, or did Roy and the film ‘follow’ the fans? Frankly, there is no‘first’ here. This is not a sequential history. The polarization of the individual and the community that underlies much of the debate between individualists and communitarians is made possible in part by the literal vanishingof civil society—the domain whose middling terms mediate the stark opposition of state and private sectors and offer women and men a space for activity that is both voluntary and public. Modern democratic ideology and the reality of our political practices sometimesseem to yield only a choice between elephantine and paternalistic government or a radically (...) solipsistic and nearly anarchic private market sector—overnment gargantuanism or private greed. Americans do not much like either one. President Clinton's callfor national service draws us out of our selfishness without kindling any affection for government. Private markets service our avarice without causing us to like ourselves. The question of how America's decentralized and multi-vocal public can secure a coherentvoice in debates over public policy under the conditions precipitated by so hollow and disjunctive a dichotomy is perhaps the most important issue facing both the political theory and social science of democracy and the practice of democratic politics in America today. Two recent stories out of Washington suggest just how grave the situation has become. Health-care reform failed in a paroxysm of mutual recrimination highlighted by the successful campaign of the private sector against a presidential program that seemed to be widely misunderstood. Basham and Dentith argue that the danger of condemning both conspiracy theorists and their conspiracy theories in a democracy has grave consequences. They argue that we should encourage research into public concerns about influential institutions, especially in cases where a conspiracy has been alleged. Rather than dismiss conspiracy theorising, we should, encourage the politically crucial, historically proven gift of watchfulness in the citizen, and its sometimes necessary, proper and correct expression, conspiracy theory.

Though whistleblowing is quickly becoming an accepted means of addressing wrongdoing, whistleblower protection laws and the relevant case law are either awkwardly silent, unclear or mutually inconsistent concerning public disclosures of classified government information. I remedy this problem by first arguing that such disclosures constitute a pro tanto wrong as they violate (1) promissory obligations, (2) role obligations and (3) the obligation to respect the democratic allocation of power. However, they may be justified if (1) the information disclosed concerns grave (...) government wrongdoing, (2) alternative channels of disclosure are first exhausted and (3) steps are taken to minimize harm. Given the crucial role unauthorized disclosures can play in uncovering grave government wrongdoing, it makes sense to search for a defense of justified cases of what I call “classified public whistleblowing.” The question that concerns me is what form such a defense should take. The main claim will be a negative one, namely, that a defense of whistleblowing cannot be based on individual rights, be they legal or moral, though this is indeed the most commonly proposed defense. The reconstruction of bacterial evolutionary relationships has proven to be a daunting task because variable mutation rates and horizontal gene transfer (HGT) among species can cause grave incongruities between phylogenetic trees based on single genes. Recently, a highly robust phylogenetic tree was constructed for 13 γ‐proteobacteria using the combined alignments of 205 conserved orthologous proteins.1 Only two proteins had incongruent tree topologies, which were attributed to HGT between Pseudomonas species and Vibrio cholerae or enterics. While the evolutionary relationships among these (...) species appears to be resolved, further analysis suggests that HGT events with other bacterial partners likely occurred; this alters the implicit assumption of γ‐proteobacteria monophyly. Thus, any thorough reconstruction of bacterial evolution must not only choose a suitable set of molecular markers but also strive to reduce potential bias in the selection of species. Forensic data banks contain biological samples and DNA extracts as well as computerized databases of coded DNA profiles of convicted offenders, arrestees and crime scene samples. When used for investigative and law enforcement purposes, DNA data banks have been successful in providing key investigative leads in hundreds of criminal investigations. A number of these crimes would never have been resolved without use of such data banks. In addition, in some limited number of investigations, the exclusion of known suspects whose DNA (...) profiles are known to be in an offender database can save valuable investigative time.Despite the above benefits, in hundreds of cases DNA samples are never collected and administrative and laboratory logjams delay prompt database searches. Furthermore, hundreds of DNA database matches languish, without any followup by law enforcement or prosecutors. These prevent or delay DNA matches and therefore can leave the public in grave risk of potential harm from recidivistic offenders who otherwise could have been apprehended and convicted if the process functioned more effectively. Il est aussi marqué par un événement particulièrement grave, le décret romain du 5 mai 1913 suspendant les Annales de philosophie chrétienne dirigées par le P. Laberthonnière avec la collaboration de Blondel. L’auteur explicite d’abord le contexte de l’intervention de Blondel en 1913, contexte où les événements littéraires ont une grande part, mais (...) où les incidences politiques marquées d’anticléricalisme, ne sont pas négligeables. C’est dans ce contexte que paraît l’ouvrage de Blondel qui veut montrer que le Catholicisme est un fait qui s’impose inévitablement, le point de vue de l’interlocuteur étant primordial dans ses exigences de raison et la variété de ses objections. Fondamentalement, la tâche de l’apologiste est de répondre aux questions difficiles que se pose l’homme qui pense. L’importance de l’ouvrage de Blondel, qui tient aux prolégomènes qu’il expose, provoquera paradoxalement de nombreux malentendus dont l’auteur expose les principaux, permettant de rétablir l’originalité et la force du projet blondélien.The project of an apologetics that Blondel put together in 1913 in How to realise the integral apologetics ? fits into a French cultural context especially rich and, for this reason, complex. It is also marked by a particularly serious event, the Roman decree of May 5, 1913, suspending the Annales de philosophie chrétienne directed by Father Laberthonnière with Blondel’s collaboration. The author first describes the context of Blondel’s intervention in 1913, a context where literary events play a big part, but where political incidents, marked by anticlericalism, are not negligible. It is in this context that the work of Blondel appears. He wants to show that Catholicism is a fact that imposes itself inevitably, the point of view of the interlocutor being primordial in his demands of reason and the variety of his objections. Fundamentally, the work of the apologist is to answer the difficult questions that arise to the person who reflects. The importance of Blondel’s work, which is based on the prolegomena that he expounds, will paradoxically provoke many misunderstandings, of which the author exposes the principle ones, but allows the originality and power of Blondel’s project to be restored. Some of my best friends are women, but I would not want my sister to marry one of them. Modern-minded persons criticize me for manifesting such out-dated prejudices, and would like to send me to Coventry for a compulsory course of reindoctrination. They may be right. It could conceivably be the case that in due course the Sex Discrimination Act will be tightened up, even to the extent of our recognizing that there are no ‘good reasons why the State should (...) not recognize contracts which are in all respects like marriage, except for the sex of the parties concerned’. We can envisage a society so enlightened that the relations between men and women will be purely platonic and it will be a matter of no concern whether two people are members of the opposite sex or not: or, alternatively, our feelings could be so completely homogenized, that it will make no difference to an emotional relationship whether Leslie and Julian have only one Y-chromosome between them, or two, or none at all. In that event I shall be shown to be wrong, and my critics entitled to erect a monument to female equality on my grave. But I have doubts, and suspect that long after I am dead men will go on falling in love with women and women will continue to find their hearts wooed and won by men. And this fact, if it is a fact, makes a profound difference to our social institutions. I want to follow out the logic of social differentiation, relying as little as I can on putative facts about the differences between the sexes. Scientifically attested knowledge is scarce in this field. Many academics take refuge in a safe suspension of judgment, but this is a craven dereliction of duty. We have yet to develop an adequate theory of knowledge in social matters, and only by thrashing out the apparently telling arguments on this and similar issues can we clear our minds about the nature of social knowledge. Moreover, if those who might argue rationally draw back from doing so, they leave the field clear for others who suffer from fewer inhibitions and fewer scruples. And finally, serious social consequences can follow from public confusion about the logic of a situation, and what things are possible and what desirable. There is a danger that in our attempts to remedy the real wrongs done to women we shall only succeed, as with much modern legislation, in making a bad case worse. (shrink)

There is a prevailing opinion that conjectural knowledge (zann) cannot be taken as a basis in determining the fundamental theological principles among the theologians. However, from which sources and how to obtain certainty (yaqīn) and which types of knowledge are definitive (qat‘ī) have been discussed extensively. Certain and conjectural knowledge meet at a common point in terms of relying on evidence. Conjectural knowledge obtained via reasoning and/or religious scripture that do not express certainty. While conjectural knowledge has been essentially related (...) to the concepts of estimation, doubt, belief and knowledge, by its in term of value, it is stands closer to the concepts of knowledge and belief. Conjectural knowledge contains different degrees of certainty. When it is chosen to be more certain, it is considered as a valid conjecture, when it is disregarded, it is considered as erroneous conjecture. If there is no choice for its certainty, then it is called doubt (shakk). If the information/judgment obtained through reasoning becomes fixed, unchangeable and in a coherence that does not allow it to be otherwise, then it is called definitive (qat‘ī) knowledge. To achieve that, theologians generally used methods of argumentations like syllogism, induction, exhaustive investigation and disjunction (al-sabr wa’l-taqsīm) to provide such knowledge about divinity and prophethood. Theologians have used conjectural knowledge, which are based on endoxic (mashhūrāt), already granted (musallamāt) and acceptance of authority (maqbūlāt), in their dialectics to persuade their discussants, rather than to justify the fundamental theological issues of religion. While theologians mostly use rational proofs in theological issues, they also gave significant place to the scriptural narrative that determines the creed. In this context, theologians accepted the narrated evidence as binding and decisive, as long as it is certain in terms of both authenticity and implication. Ultimately, the fundamental theological principles of religion are based on these narrative evidences. Although the theologians do not accept single reports (khabar al-wahid) for their questionable authenticity, they also made inferences regarding subjects of traditions (sam‘iyyāt). Acting from this perspective, theologians tried to justify with narrative evidence rather than rational arguments on these issues such as torment in grave, intercession (shafā‘ah) and sirât, which are mostly matters of eschatology and the unseen (ghayb). Finally, it has been concluded that the conjectural knowledge is still valid in some secondary theological issues and the assumption that the conjectural knowledge has no deduction value in theology is not absolute. Peter Winch's The Idea of a Social Science has been the subject of repeated misunderstanding. This discussion takes one recent example and shows how Winch's argument is gravely distorted. What is at issue is not, as is usually supposed, whether we can accept or endorse another society's explanations of its activities, but whether we have to look for an explanatory connection between concepts and action. Winch's argument is that before we can try to explain actions, we have to identify them (...) correctly. This can only be done by seeing how they, and the concepts they are associated with, fit within a way of life. Grasping its rule?following character is understanding action. Once the difficulties in making such identifications are appreciated, we will be less inclined to accept facile explanations why people in other societies do the things they do. (shrink)

          The production of a number of vaccines involves the use of cell-lines originally derived from fetuses directly aborted in the 1960s and 1970s. Such cell-lines, indeed sometimes the very same ones, are important to on-going research, including at Catholic institutions. The cells currently used are removed by a number of decades and by a significant number of cellular generations from the original cells. Moreover, the original cells extracted from the bodies (...) of the aborted fetuses were transformed to produce the cell lines, since otherwise they would be incapable of the kind of culturing that is required.           It is generally acknowledged by ethicists, including many Catholic ones generally considered to be orthodox, and by the U.S. bishops, that the use of the cell-lines in connection with the production of vaccines is morally permissible. It does not appear that there is a relevant qualitative difference between the use of the cell-lines in vaccines and in research. One might argue that there is certainty of benefit from a vaccine while the benefits of research are uncertain. However, in any given case of the administration of a vaccine to an individual, it is far from certain that such administration will be of benefit to that individual. After all, the individual might never come in contact with someone infected with the disease in question, particularly if the disease is now uncommon in the individual’s locale. Yet, it is morally certain that some of the administrations of the vaccine will be beneficial. This is parallel to the fact that while any one research project might not be beneficial, the history of biomedical research makes it extremely probable, indeed morally certain, that some project involving the use of such cell-lines will be beneficial. There may, of course, be quantitative difference between the cases—the probabilities and benefits may not be equal—but the difference does not seem to be a qualitative one. Therefore, if one accepts the use of the cell-lines in vaccines, one should accept the use in research in at least some conceivable and perhaps actual circumstances.           The main argument I am interested in in favor of the use of the cell-lines proceeds by first granting that the initial abortion and extraction of cells from the deceased fetus was morally gravely illicit. However, the connection between the currently used derived cells and the abortion and original derivation is sufficiently remote that the use becomes licit. Not all fruit of a poisoned tree is poisoned: it can be morally....           Despite the fact that the strength of argument is clearly on the pro-life side—nobody except a handful of academics would question the grave wrongness of abortion were pregnancy never inconvenient—somehow ordinary intelligent people, like our students, often remain unconvinced. There are many reasons for this, of course. For instance, a number of students have had their children aborted while many know others who have had abortions, and one does not want (...) to condemn oneself or oneÂ’s friends. I am a philosopher, however, and so I will be interested in intellectual reasons, even though these subjective psychological ones are almost surely more important. Specifically, I will be interested in the fact that the ordinary person subscribes to a number of erroneous big-picture ethical beliefs, each of which, to a different degree, does something to block access to the pro-life arguments. I will not talk about all such erroneous beliefs and I would be grateful in the discussion for more examples.           I will talk about eight errors I have identified, largely through teaching. For each one, I will identify the error, show how it impacts the pro-life message and explain why it is tempting to most of us —there is, after all, something right about five of the errors. For each of these errors is one that we might ourselves be tempted by on occasion. I will then suggest some ways of refuting the error. In some cases, the mere identification of the error should do the trick, as these erroneous beliefs are often not explicitly identified by our interlocutors. My suggested refutations will not always be phrased in the way in which I would phrase them for didactic effectiveness: in this talk, I am mainly trying to convey ideas. The announcement of the birth of Dolly the cloned sheep evoked widespread response from the Christian Churches. These responses are identified, organized thematically, and discussed critically. The churches have viewed reproductive human cloning either with unqualified opposition or with grave suspicion. Some statements have discussed animal cloning, generally granting limited approval, and nonreproductive human cloning, either in opposition or expressing an openness to entertain specific proposals as the technology develops.
